1. Agreement to Terms

By accessing or using zillykick.com (the "Site") or purchasing from ZillyKick LLC ("ZillyKick", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Shipping Policy, Return & Refund Policy, and all applicable laws. If you disagree, do not use the Site.

2. Eligibility

  • You must be 18+ years old (or age of majority in your jurisdiction)
  • Minors may use the Site only with parent/guardian supervision
  • You must provide accurate, current, complete account info

3. Products & Availability

  • All products subject to availability — we reserve right to limit quantities
  • Colors may vary slightly from screen display
  • Limited-edition / collab drops: one per customer/household; we may cancel duplicate orders
  • Pre-orders: estimated ship dates are best estimates, not guarantees

4. Pricing & Payment

  • Prices in USD; subject to change without notice
  • Sales tax collected per state nexus laws
  • Accepted: Visa, Mastercard, Amex, Discover, Shop Pay, Apple Pay, Google Pay, PayPal, Klarna (installments)
  • Payment captured at order placement (not at ship)
  • Failed payments: order held 48 hrs then cancelled

5. Intellectual Property

  • All content (logos, photos, copy, designs, "Sole Guardian" branding) © ZillyKick LLC
  • No reproduction, distribution, or derivative works without written permission
  • User-generated content (reviews, photos, #ZillyKick tags): you grant us royalty-free, worldwide, perpetual license to use for marketing

6. User Conduct

You agree NOT to:

  • Use the Site for unlawful purposes or to violate any law
  • Interfere with Site security, scrape, bot, or automate purchases
  • Resell ZillyKick products commercially without written authorization
  • Post defamatory, obscene, or infringing content
  • Attempt to gain unauthorized access to accounts or systems

7. Account Registration

  • Create account via email, Google, Apple, or Shop Pay
  • You're responsible for password security & all activity under your account
  • Notify us immediately of unauthorized use: security@zillykick.com
  • We may suspend/terminate accounts for Terms violations

8. Loyalty Program — Sole Guardian

Participation governed by Loyalty Program Terms. We reserve the right to modify, suspend, or terminate the program with 30 days' notice.

9. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT. WE DON'T WARRANT UNINTERRUPTED OR ERROR-FREE ACCESS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZILLYKICK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, DATA, OR GOODWILL) ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE PRODUCT/SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold ZillyKick LLC, its officers, employees, and affiliates harmless from any claims, damages, or expenses (including attorneys' fees) arising from your breach of these Terms or misuse of the Site/products.

12. Governing Law & Dispute Resolution

  • Governing Law: State of Delaware, USA
  • Venue: State/federal courts in New Castle County, Delaware
  • Informal Resolution: Contact legal@zillykick.com — we'll try to resolve in 30 days
  • Binding Arbitration: If informal fails, disputes resolved via JAMS arbitration (individual basis, no class actions)
  • Opt-out of arbitration: Email legal@zillykick.com within 30 days of first purchase

13. Modifications

We may update these Terms at any time. Material changes posted on Site + emailed 30 days prior. Continued use = acceptance.

14. Severability & Waiver

If any provision is unenforceable, the rest remain in effect. Failure to enforce a right ≠ waiver.
